My husband got served papers over a fender-bender from 2 years ago — is this normal??
I'm still kind of in shock and honestly just need to talk to people who've been through something like this.
About two years ago my husband tapped the car in front of him while merging on a busy surface street — we're talking maybe 5 mph, barely a scratch on the other bumper. The other driver got out, said she was fine, they exchanged info, and that was it. Our insurer at the time handled a small property damage claim and we thought it was 100% done.
Fast forward to last Thursday: a process server shows up at our door and my husband is being sued. The complaint is asking for a pretty significant sum — way more than what anyone at the scene acted like was at stake.
Some wrinkles that are stressing me out:
- We switched insurance companies about 8 months after the accident (the old carrier non-renewed us for unrelated reasons)
- We're now with a completely different insurer
- Our old insurer technically still existed as our carrier on the date of the accident
My questions for anyone who's been here: 1. Does the insurance policy that was active at the time of the accident cover a lawsuit that shows up years later? 2. Should my husband contact the old insurer directly, or does the lawyer handling the service do that? 3. Do we need to go get our own attorney on top of whatever the insurer does?
I've been googling myself in circles and getting more confused by the minute. We're not wealthy people — this kind of liability terrifies me. Any lived experience would mean a lot right now. 😔
