Rental car driver hit me, not authorized on the rental — am I just stuck eating the difference?
So this happened a few months back and I'm still trying to figure out what my options are.
A guy ran a red light and T-boned me at an intersection. Clear-cut fault — there's a traffic cam that caught the whole thing. Here's where it gets messy: he was driving a rental that was checked out by someone else entirely, and he was never added as an authorized driver. The rental company is basically washing their hands of it, and his own personal auto policy is denying the claim for the same reason.
My insurance stepped in and covered my car and most of my medical bills, which I'm grateful for. But after my deductible, some out-of-pocket treatment costs, and a few days of missed work, I'm still sitting on a gap that feels really unfair to just absorb.
My insurer told me they'd send a demand letter to the guy on my behalf for their subrogation — but as for my leftover costs, they said that's kind of on me to pursue separately.
The kicker? This guy has been completely unresponsive. Didn't leave proper info at the scene, has ignored every attempt to contact him, and from what I can tell never reported anything to anyone.
I keep going back and forth on whether small claims court is worth it, or if I need an actual attorney involved. Has anyone been through something like this? Is it even worth chasing someone who seems to be actively dodging everything?
