Attorney got the settlement check — how long until I actually see the money?

So we finally got to the finish line after what feels like forever dealing with this whole mess. My attorney's office called me last week to let me know the insurance company issued the settlement check and it's been deposited into their trust account as of a few days ago.

I'm honestly relieved just to be at this stage — it's been almost a year since the accident and between the physical therapy, the back-and-forth with the adjuster, and just the general stress of it all, I'm ready for this chapter to close.

But now I'm in this weird limbo where the money exists but I don't have it yet. My attorney's paralegal mentioned something about the check needing to clear before they can disburse anything, which makes sense I guess, but nobody gave me a real timeline.

A few things I'm wondering about:

How long does clearance usually take for a check like this? Days? A week?
After it clears, how long before they actually cut me my portion and send it?
Is there a breakdown I should expect showing how the settlement was divided — like their fees, any liens, my amount?

I know every situation is different but just looking for ballpark experiences from people who've been through this. I feel dumb asking my attorney's office again because I already called once and don't want to seem like I'm being a pest. Has anyone else been in this waiting period?

I went through almost the exact same thing last year. For me the check cleared in about 3-4 business days, and then it took another week or so for the office to process everything — pay off my medical liens, deduct their fees, and cut my check. So roughly two weeks total from deposit to money in my hands. Felt like forever but it did come.

  So the clearance part is usually pretty quick — most attorney trust accounts are set up with banks that clear settlement checks within 5-7 business days, sometimes faster. The part that can stretch it out is the lien resolution side. If you had health insurance pay for any of your treatment, or if there's a Medicare/Medicaid component, the firm has to make sure all those are settled before disbursing. Ask your paralegal specifically if there are any outstanding liens — that's usually what causes delays more than the bank stuff.

  Just make sure when you get your disbursement statement that you review every single line item. I've heard of people not paying close attention and not realizing certain deductions were taken that they didn't fully understand or agree to. You're entitled to a full accounting of where every dollar went — don't be shy about asking for it in writing.

  Not legal advice, but — you are 100% entitled to a disbursement sheet showing the full breakdown before you sign off on anything. A reputable attorney will provide this automatically, but if they don't offer it upfront, just ask. Also, calling your attorney's office to ask about your own money is completely normal and not at all annoying. That's literally what they're there for. Don't feel bad about it.

Call them again. Seriously. You're not being a pest — this is your money and your case. A simple 'hey, just checking on the timeline for disbursement' is a totally reasonable ask. You paid them to handle this for you.

From my time on the other side of this, once the check leaves the insurance company it's really out of their hands. The timeline from there is all about the trust account and lien clearances like others mentioned. One thing I'd add — make sure the check was issued to both you and your attorney jointly, which is standard, vs. just the attorney. Either way is fine but it affects how the paperwork flows. Your attorney's office will know.
