Got hit from behind in a chain reaction — 3 cars involved, no idea who actually struck me first

So this happened about two weeks ago on the highway during stop-and-go traffic. I was fully stopped when I got hit from behind, and the impact pushed me into the car ahead of me. When I got out, there were actually THREE vehicles behind me involved in the whole mess — and honestly the chaos of the scene made it impossible to tell in the moment which one made first contact with my bumper.

Here's my situation: I only carry liability on my own policy, so I can't just file through my own collision coverage and let them sort it out. I need to file against whoever actually caused this. But how am I supposed to know which of the three drivers is the one responsible? They were all kind of pointing fingers at each other on the scene.

I did get all their insurance info and the police report is filed — waiting on a copy. I have photos of the damage to the back of my car and the general scene.

Questions I'm trying to figure out:

Do I need to identify the "primary" at-fault driver before I can file, or can I file against all three?
If I file against all three, does that cause problems?
Is there a risk one of them countersues me for the front damage even though I was stopped?

I'm not hurt badly but my neck has been sore and I went to urgent care the day after just to get it documented. Really stressed about how to even start this process when the fault is so muddy. Any advice from people who've been through something similar?

I was in almost the exact same situation a couple years back — multi-car pileup, nobody wanted to admit who hit who first. What I ended up doing was filing claims with all of the drivers' insurance companies simultaneously. Let THEM investigate and figure out the liability split. You don't have to solve that puzzle yourself. The police report ended up being really useful in sorting it out.

You can absolutely put all three insurers on notice at the same time — that's actually the smart move here. Filing a claim doesn't mean you're accusing someone of 100% fault, it just starts the investigation. Each insurer will send out their own adjuster, review the police report, look at damage patterns, maybe pull any nearby traffic cam footage. Damage patterns on your vehicle can actually tell a lot about the direction and sequence of impacts. Keep all your urgent care records too — that documentation matters even for something that feels minor right now.

  Really glad you went to urgent care. Neck soreness after a rear-end hit can sometimes take days to fully show up, and having that early documentation is huge. Please follow up with your regular doctor if anything changes or gets worse — don't just assume it'll resolve on its own. Soft tissue stuff from these crashes can linger longer than people expect.

Former adjuster here. Contact all three insurers. Seriously, don't wait or try to figure out fault on your own — that's literally the adjusters' job. When I worked claims, chain-reaction rear-end cases like this weren't uncommon, and we'd coordinate with the other carriers to determine how liability gets shared. Sometimes it ends up 100% on one driver, sometimes it gets split. Either way, it's not your burden to prove before you even open a claim.

Just be careful — once you start talking to any of those insurance adjusters, they may try to get a recorded statement from you quickly. Don't do it without knowing your rights first. They're friendly but their job is to minimize payouts. The fact that you were pushed into the car ahead of you does NOT make you at fault for that front impact, but an adjuster might try to blur that line.

Not legal advice, but generally speaking — in chain-reaction crashes, liability can be shared among multiple rear drivers, and you as the stopped vehicle at the front are typically in a strong position. The fact that three insurers are involved doesn't hurt you; it can actually work in your favor because they may end up competing to point the finger at each other rather than at you. Given the neck injury and the multi-party complexity, it might be worth at least a free consult with a PI attorney before you start talking to any of the insurers.

File with all three TODAY. Don't wait for the police report to arrive, don't wait to figure out who's "most at fault." Just call or go online and open a claim with each carrier. You can always update with the report number later. Every day you wait is a day an adjuster somewhere is already building their file without your input.
