Got hit from behind in a chain reaction — 3 cars involved, no idea who actually struck me first
So this happened about two weeks ago on the highway during stop-and-go traffic. I was fully stopped when I got hit from behind, and the impact pushed me into the car ahead of me. When I got out, there were actually THREE vehicles behind me involved in the whole mess — and honestly the chaos of the scene made it impossible to tell in the moment which one made first contact with my bumper.
Here's my situation: I only carry liability on my own policy, so I can't just file through my own collision coverage and let them sort it out. I need to file against whoever actually caused this. But how am I supposed to know which of the three drivers is the one responsible? They were all kind of pointing fingers at each other on the scene.
I did get all their insurance info and the police report is filed — waiting on a copy. I have photos of the damage to the back of my car and the general scene.
Questions I'm trying to figure out:
- Do I need to identify the "primary" at-fault driver before I can file, or can I file against all three?
- If I file against all three, does that cause problems?
- Is there a risk one of them countersues me for the front damage even though I was stopped?
I'm not hurt badly but my neck has been sore and I went to urgent care the day after just to get it documented. Really stressed about how to even start this process when the fault is so muddy. Any advice from people who've been through something similar?
